Accuracy

The details, descriptions, and assessments regarding accommodations, national parks, wildlife sightings, itineraries, security measures, and gorilla permits have been provided in good faith, relying on the information available to us at the present time. We have taken care to ensure that the information is current and accurate. However, we cannot assume liability or responsibility for any omissions or errors that may arise due to circumstances beyond our control.

CANCELLATIONS

a) What Happens When We Cancel Your Trip

On rare occasions, circumstances may compel us to cancel confirmed bookings, a decision we strive to avoid but reserve the right to enact. These cancellations arise from unforeseen circumstances beyond our control. We make every effort to mitigate such occurrences but may cancel only if no alternative solutions are feasible. In the event of cancellation, we will offer you the opportunity to select a similar holiday in terms of standard and duration. However, this option is not extended if the cancellation results from payment failure or force majeure events.

Should the alternative holiday be less expensive, we will refund the difference. Conversely, if it is more expensive, we will request payment of the price discrepancy. If the alternative does not meet your requirements, you are entitled to a full refund of all payments made to us, excluding gorilla permit fees, subject to refund availability.

We bear no further liability for cancellations beyond those specified in this clause and regret that we cannot cover any costs, expenses, or losses resulting from such cancellations.

Furthermore, we retain the right to terminate the holiday of any individual in your group without prior notice if, in our judgment or that of relevant authorities, their behavior poses a threat, annoyance, or distress to others or property. In such cases, the individuals in question will be required to vacate the service or accommodation. No refunds will be provided, and we will not cover any associated costs or expenses. Our obligations toward such individuals will cease immediately.

b) If You Cancel The Trip

If you or any member of your group needs to cancel a booking, you must notify us in writing. Until we receive written notice, the cancellation is not considered effective. Please be aware that we may not be able to resell your holiday to cover the estimated loss caused by your cancellation. Therefore, a cancellation fee (excluding insurance) will be charged per person. The cancellation fees are determined based on the date we receive your written notification at Kenlink Tours.

Cancellation fees are as follows:

  • 101 days and above before the tour: 30% of tour cost
  • 61-100 days before the tour: 40% of tour cost
  • 46-60 days before the tour: 60% of tour cost
  • 16-45 days before the tour: 90% of tour cost
  • 0-15 days before the tour: 100% of tour cost.

Complaints

If you have any complaints about the services offered, please report them as soon as possible to the service provider and our representative so that we can resolve the issue promptly. If you remain dissatisfied, please write a report to our Tour Managers in our office within 20 days of the completion of your holiday to allow us to conduct a thorough investigation. Unfortunately, we cannot be held liable for any complaints received after this period or for complaints not reported through the proper channels.

Force Majeure

We regret that we cannot accept liability or provide compensation if the proper performance of our obligations is prevented or affected by events that we or the service provider could not, even with all due care, avoid or foresee. Such events include civil strife, riots, border closures, epidemics, pilferage, quarantines, unexpected government actions, terrorist activities, fire, road closures, extreme weather conditions, war or threats of war, industrial disputes, natural disasters, dangers associated with sea, land, and air travel, and other similar acts or incidents beyond our control.

We often book accommodations, transportation, restaurants, and other services from various independent suppliers who are not subject to our control. Therefore, we cannot be liable for any personal injury, damage to property, death, or other loss that may occur due to the actions or omissions of a supplier or any other event beyond our control.

Tariffs and foreign exchange rates fluctuate from time to time, and for this reason, we reserve the right to revise our US Dollar prices without prior notification. We also reserve the right to alter the agreed itinerary, including ending a tour if deemed necessary, and to pass on any new expenditures or losses resulting from unforeseen delays or events to tour members.

Optional Activities

Optional activities may be available at some locations depending on your chosen itinerary. Participation in these activities may carry inherent risks of personal injury. These activities include, but are not limited to, canoeing, nature walks, white-water rafting, boat trips, chimpanzee tracking, gorilla tracking, balloon tours, and mountain climbing.

You are free to participate in these activities, but your personal safety cannot be guaranteed. Participation in these activities is at your own risk, and we assume no responsibility for your safety. We guarantee safety and insurance for only activities that are included in the official itinerary. Our activities mentioned in the itineraries include the safari insurance. 

Gorilla Permits

Permits for gorilla trekking can only be purchased upon receipt of payment. Having a gorilla permit does not guarantee seeing the gorillas, as local conditions can make access to them impossible on short notice. There is a 98% chance of seeing the gorillas. We cannot accept liability for circumstances that may lead to the cancellation of gorilla watching, whether due to security situations, border closures, national park closures, or the absence of gorillas. Any refunds are at the discretion of the relevant authority, and we cannot accept liability. We will do everything in our power to obtain a refund from the relevant authority and pass it on to the traveler/client.

However, our team will always keep you updated about any changes to be made.

Photography on Safari

We reserve the right to take photos of our clients for commercial promotion of our tours. Individuals who do not wish to have their images used are required to identify themselves at the start of the tour.

Insurance

Before embarking on your holiday with us, it is advisable to arrange appropriate insurance tailored to the specific nature of your trip. Such insurance should fully cover personal injury, death, repatriation in the event of accident, illness, or death, and all medical expenses. Additionally, the insurance should include coverage for any cancellation or curtailment of the holiday, and damage to or theft of property. Risky activities such as mountaineering, white-water rafting, and animal tracking should also be covered. Mission Africa Safaris only covers the evacuation of clients on a full safari.

Jurisdiction

Kenlink Tours And Travel  is incorporated in the Republic of Uganda and operates under Ugandan law. 

Liability

We will make every reasonable effort to ensure that:

  • Our employees, suppliers, sub-contractors, and other agents carry out our obligations with due care as stipulated in the contract.
  • All activities and services are provided as agreed at the time of booking and to a reasonable standard.

We accept responsibility for the actions or omissions of our agents, suppliers, sub-contractors, and employees, provided they were performing authorized work at the time. If you follow the complaints procedure set out in the terms and conditions and any part of your holiday is not provided to an acceptable standard as agreed, we will pay appropriate compensation. This acceptance of responsibility is subject to these Terms and Conditions and the “Force Majeure” clause.

Our maximum liability for complaints, except where personal injury, illness, or death results, or where claims relate to damage or loss to luggage or possessions, is limited to the amount paid by or on behalf of the affected person for the relevant services. The maximum amount will only be payable if none of the contracted services have been provided, and the affected person did not benefit from the safari holiday.

We will take all due care to prevent injury, illness, or death caused by insect life or animals at the destinations. It is your responsibility to take proper practical and medical precautions. You should seek medical advice well before traveling. We accept responsibility, subject to these Terms and Conditions, if you or any of your party suffer illness, personal injury, or death due to the improper performance of the contract by any of our suppliers, agents, sub-contractors, or employees (provided they were performing authorized work), except in the following situations:

  1. An event that we or the supplier could not avoid or foresee, even with due care.
  2. Acts or omissions of a third party not connected with the holiday provision under the contract and which were unavoidable or unforeseeable.

All claims must follow the complaints procedure set out above. Any person receiving a payment (and their guardian or parent if the traveler is a minor) must assign to us and our insurers any rights they may have to pursue any third party in connection with the claim and provide all necessary assistance to us and our insurers as reasonably required.

Medical Requirements

Good mental and physical health is crucial to fully enjoy outdoor tours. While on your tour, you may travel through remote and rugged areas away from good medical facilities. Trekking, in particular, requires good physical condition.

By booking with us, the traveler certifies that they do not have any disability (physical or otherwise) that would endanger themselves or other travelers. Clients must notify our staff in advance of travel if they have a medical condition requiring regular treatment, specific allergies, dietary restrictions, or any other medical condition that may be affected by vigorous activity, heat, high altitude, cold, or other natural phenomena.

We assume no liability for any special dietary requirements or medical care if not notified in advance.

Payment

You should confirm acceptance of these terms and conditions at the time of booking and pay a deposit of 40% of the holiday price, including fees for gorilla permits. We will assume acceptance of the Terms and Conditions if we do not receive written acceptance at the time of booking and making the initial deposit. The balance must be paid before arrival or at the start of the safari. We reserve the right to request full payment at least 30 days before the safari begins.

Bookings, Prices, and Quotations

Before confirming a booking, ensure the quotation is accurate and clear with all details of dates, accommodation, transportation, number of clients, park fees, permits, and all services to be provided. References to quotations in writing include correspondence by facsimile and electronic mail. At the time of booking, the holiday price will be confirmed. We reserve the right to correct any errors in both confirmed and advertised prices as soon as we notice them. We take every care to provide accurate figures.

Safari Terms

Prices INCLUDE:

  • Services of an English-speaking guide/driver and a 4×4 safari vehicle.
  • Airport transfers.
  • Portage of two items of baggage per person.
  • Meals as stated.
  • Park fees.
  • Government taxes.
  • Chimpanzee and gorilla permits, where applicable.

Prices EXCLUDE:

  • Items of a personal nature such as telephone calls, tips, laundry, airport taxes, gifts, and alcoholic drinks.
  • The prices cover full board while on safari.

We reserve the right to change the agreed safari services in the event of unforeseen circumstances, such as insecurity, bad weather, road closures, and issues with hotels or national parks. Alternative arrangements will be made if circumstances permit.

Transportation

We strive to ensure that the safari vehicles used are comfortable and in sound mechanical condition, but no liability can be accepted for any damage, breakdown, or delays. Every person is entitled to a window seat in the vehicle. Our guides/drivers must follow our code of conduct for Guides, which you must not ask them to break in any way. The company guide is the sole driver and final decision-maker on all matters, such as the route to be taken. Any interference by you with the safari vehicle makes you liable for any damage caused, including legal costs. It is the responsibility of the company guide to rectify all situations, including any breakdowns. In the case of a vehicle breakdown, the company guide can either rectify it or we can withdraw the vehicle in question and replace it. We reserve the right to do so.

If a guide does not follow the code of conduct (available on request), please inform the Tour Manager at the head office in writing.

Voluntary Execution

Advancing a deposit to Kenlink Tours certifies that you have carefully read and fully understood the Terms and Conditions, especially those regarding the responsibility of trip participants, cancellation and refund policies, and limitation of liability. By advancing a deposit to Kenlink Tours, the depositor, their family, and heirs agree to be bound by these Terms and Conditions.
